Terms & Conditions

These Terms govern participation in the Cutty Kiddies Contest online kids' image and video competition. Submitting an entry constitutes full, unconditional acceptance.

1. Definitions

  • “Cutty Kiddies” refers to the company organising and operating the Competition.
  • “Participant / Child” means any eligible minor entered into the Competition.
  • “Parent / Guardian” means the legally responsible adult approving or submitting the entry.
  • “Entry” means any photograph, image, video, caption or related media submitted.
  • “Website / Platform” means any online platform owned or managed by Cutty Kiddies for competition purposes.
  • “Prize(s)” means rewards awarded to winning participants.
  • “Personal Data” means identifiable information relating to participants or parents.

2. Eligibility

  • The Competition is open only to minors whose entries are submitted by their parent or legal guardian.
  • Participants must fall within the age categories published by Cutty Kiddies.
  • Parents/guardians must legally represent the child, provide verifiable contact details and reside in an eligible region.
  • Employees, contractors, officiants or affiliates of Cutty Kiddies, including their family members, are not eligible.
  • Cutty Kiddies may verify identity, age and guardianship at any time.

3. Entry requirements

  • All entries must be submitted electronically through the official Cutty Kiddies platform.
  • Entries must be original and feature only the child or individuals with explicit consent.
  • Entries may not contain nudity or inappropriate attire, dangerous or illegal acts, hateful or offensive material, or unauthorised logos and copyrighted works.
  • Late or incomplete entries may be rejected at Cutty Kiddies' discretion.
  • Cutty Kiddies reserves the right to reject, remove or disable any entry.

4. Parent / guardian consent and responsibility

  • By submitting an entry the parent consents to the child's participation and confirms all information is accurate.
  • The parent assumes full legal responsibility for the entry and warrants it breaches no rights or laws.
  • Parents must ensure every minor visible in an entry has guardian consent and that no child was exposed to harm during content creation.

5. Intellectual property

  • Parents/guardians retain copyright ownership of the entry.
  • Submitting an entry grants Cutty Kiddies an irrevocable, perpetual, royalty-free, worldwide licence to reproduce, publish, edit, distribute and display it.
  • Entries may be used for marketing, promotion and advertising across digital, broadcast and print platforms without further notification or compensation.

6. Competition process and judging

  • Competition rules, timelines and judging criteria are published on this website.
  • Cutty Kiddies may adjust rules, modify judging structures, replace judges and disqualify participants for misconduct.
  • Fraudulent votes — bots, fake profiles or purchased engagement — are strictly prohibited and may be audited or nullified.
  • Judges' decisions are final and binding.

7. Prizes

  • Prizes are awarded on the criteria published by Cutty Kiddies and are non-transferable, non-refundable and non-exchangeable.
  • Cutty Kiddies may substitute a prize with one of equal or greater value.
  • Parents are responsible for correct delivery information and any taxes, duties or fees relating to prizes.
  • Prizes not claimed within the stated time frame may be forfeited.

8. Privacy and data protection

  • Cutty Kiddies complies with applicable data protection laws, including POPIA.
  • Data collected may include the child's name, age, images and video, plus the parent's name and contact details.
  • Data is used to administer the competition, communicate with parents, publish entries under the granted licence and market Cutty Kiddies events where consent allows.
  • Cutty Kiddies may publicly share the participant's first name, entry content and ranking or winning status.
  • Access, modification and deletion requests may be submitted in writing.

9. Disqualification

Cutty Kiddies may disqualify any participant or parent for violating these Terms, misconduct or harassment, fraud or manipulation, offensive content, tampering with public voting or platform functionality, or breaching intellectual property rights — even after a win or prize issue if violations are discovered later.

10. Limitation of liability

  • Cutty Kiddies is not liable for late, lost, corrupted or misdirected entries, technical failures or outages, unauthorised third-party access, or damages arising from participation or prize use.
  • Parents indemnify Cutty Kiddies against claims related to submitted content, breaches of these Terms and unauthorised use of protected material.
  • Total liability shall not exceed the value of the prize associated with the relevant claim.

11. Warranties

By participating the parent warrants that they have full legal authority to consent, that the entry is original and lawful, that it infringes no copyright or other rights, that content creation did not endanger the child, and that the entry contains no harmful code.

12. Image, likeness and publicity

Parents grant Cutty Kiddies permission to use the child's name, image, likeness, voice and entry for promotional, advertising, editorial and social media purposes. No further consent or compensation is required.

13. Social media

Where entries involve social media, all platform terms apply. Cutty Kiddies is not responsible for content removal, policy changes or account restrictions, and the Competition is not sponsored, endorsed or administered by any social media platform.

14. Modification, suspension or termination

Cutty Kiddies may modify these Terms at any time, and may cancel or suspend the Competition due to system failure, fraud, legal compliance issues, insufficient participation or operational challenges. In the event of cancellation, prizes are not required to be awarded.

15. Governing law and disputes

These Terms are governed by the laws of South Africa. Disputes must first be raised in writing with Cutty Kiddies, then handled through mediation followed by binding arbitration unless prohibited by law. Class action waivers apply; disputes must be brought individually.

16. Severability and entire agreement

If any section is deemed invalid, the remaining provisions continue in full force. These Terms constitute the complete agreement between the parent/guardian and Cutty Kiddies and supersede all prior communications.

17. Acceptance

By submitting an entry, the parent/guardian confirms they have read, understood and agree to these Terms, consents to the child's participation, agrees to Cutty Kiddies' use of the entry, and accepts full responsibility for compliance.
